Retired Hawks Colonel Accuses IDAC Boss of Obstructing Feroz Khan-Linked Investigation

PRETORIA – Retired Hawks Colonel Kobus Roelofse has levelled serious allegations against Investigating Directorate Against Corruption head Advocate Andrea Johnson during testimony before the Madlanga Commission.

Roelofse accused Johnson of allegedly defeating the ends of justice and obstructing a criminal investigation connected to suspended Crime Intelligence deputy head Major General Feroz Khan.

The former Hawks investigator claimed that Johnson’s actions derailed an assault and intimidation case involving Khan and a senior South African Police Service officer.

The allegations formed part of Roelofse’s evidence concerning challenges he allegedly encountered while investigating criminal matters involving senior figures within the police and intelligence structures.

Roelofse alleges investigation was obstructed

According to Roelofse’s testimony, a criminal complaint had been opened against Khan following allegations involving a SAPS colonel.

Roelofse claimed that decisions allegedly taken by Johnson prevented the investigation from proceeding as it should have.

His evidence suggested that investigators faced interference while attempting to pursue the matter, raising questions about whether senior law-enforcement officials received preferential treatment.

The allegations against Johnson remain untested evidence before the commission and have not been confirmed as findings of wrongdoing.

Johnson must still be afforded an opportunity to respond fully to the claims.

Feroz Khan remains under Madlanga Commission spotlight

Khan has emerged as a central figure in recent proceedings at the Madlanga Commission, which has been examining allegations of criminality, political interference and corruption within South Africa’s criminal justice system.

The commission’s official hearings programme confirms that evidence concerning Khan has recently formed a major part of its proceedings.

Evidence relating to the suspended Crime Intelligence deputy head was also read into the commission’s record earlier in July.

Previous evidence and court papers placed before the inquiry have contained several allegations concerning Khan’s activities, relationships and handling of sensitive information. Those claims similarly remain subject to examination and must not be treated as proven facts.

Questions over accountability in law enforcement

Roelofse’s testimony is likely to intensify scrutiny of how investigations involving senior police officials are managed.

The allegation that the head of a specialist anti-corruption body may have obstructed an investigation strikes at the heart of the commission’s mandate.

The inquiry was established to investigate alleged criminal infiltration, political interference and corruption within institutions responsible for policing, prosecution and the administration of justice.

Roelofse’s evidence raises several questions, including who authorised decisions affecting the Khan-linked investigation, whether normal investigative procedures were followed and whether investigators were prevented from carrying out their duties.

Commission yet to make findings

The Madlanga Commission has not made a final determination on Roelofse’s allegations against Johnson.

Evidence presented during commission proceedings may be challenged, tested through questioning or contradicted by other witnesses before any conclusions are reached.

Johnson’s response will therefore be important in establishing whether the investigation was improperly obstructed or whether the decisions questioned by Roelofse had a lawful explanation.

The commission’s hearings are continuing.
