Paul O’Sullivan Vows Court Action to Block Nhlanhla Mkhwanazi’s Hawks Appointment
Renowned forensic investigator Paul O’Sullivan has vowed to launch a legal battle to block the potential appointment of KwaZulu-Natal Police Commissioner, Lieutenant-General Nhlanhla Mkhwanazi, as the new national head of the Directorate for Priority Crime Investigation (the Hawks).
O’Sullivan has fiercely declared that he will take the matter directly to court to halt the process, asserting that Mkhwanazi is entirely unfit to command South Africa’s premier elite anti-corruption and organized crime unit.
The fierce opposition from O’Sullivan follows intense public speculation and recent discussions regarding a leadership shift that would see Mkhwanazi move from his provincial post to head the national specialized unit.
“I will not allow General Nhlanhla Mkhwanazi to be appointed as the head of the Hawks,” O’Sullivan stated, underscoring his intent to seek a judicial review if the appointment proceeds.
According to O’Sullivan, Mkhwanazi lacks the requisite suitability and integrity required to direct an institution of such critical national importance.
This legal threat marks the latest flashpoint in a long-standing feud between the two prominent law enforcement figures.
Earlier this year, O’Sullivan publicly accused Mkhwanazi of running unauthorized parallel police networks.
In retaliation, Mkhwanazi slapped the veteran forensic investigator with a R5 million defamation lawsuit, accusing O’Sullivan of trying to silence whistleblowers and damage his reputation.
The controversy comes at a time when the Hawks are under immense pressure to clean up state institutions and dismantle sophisticated criminal networks.
As a specialized unit within the South African Police Service (SAPS), the Hawks are mandated to investigate national priority offenses.
The unit regularly handles sensitive, multi-million-rand cases that directly target, high-ranking government officials and corrupt state entities, politicians involved in political killings, fraud, and tender corruption, international drug cartels and syndicates moving millions in illicit contraband.
While some civil society sectors and political commentators view Mkhwanazi as an uncompromised, ground-level operator capable of aggressively tackling institutional corruption, O’Sullivan’s looming court challenge threatens to turn the appointment process into a protracted legal showdown.
