JSC Declines to Launch Tribunal Investigation Into Judge Norman Davis Following Split Vote
The Judicial Service Commission (JSC) has officially decided against establishing a Judicial Conduct Tribunal to investigate Gauteng High Court Judge Norman Davis, following a split vote on the matter.
The decision, announced via a media statement issued by the JSC Secretariat on 3 November 2026, stems from a meeting held on 9 October 2026.
During the session, the Commission—convening without its parliamentary members from the National Assembly and National Council of Provinces—reviewed a report from the Judicial Conduct Committee (JCC) concerning a complaint brought forward by Hans du Plessis.
The JCC had previously recommended that Du Plessis’s allegations against Judge Davis warrant an in-depth investigation by a formal Tribunal under section 19(1)(a) of the Judicial Service Commission Act.
However, the proposal failed to pass after failing to secure a clear majority vote from the Commission members.
“As a result, the Commission will not request the Chief Justice to appoint a Tribunal,” the statement confirmed. The dismissal effectively halts further formal tribunal proceedings regarding the specific grievances raised by Du Plessis against the Gauteng Division judge.
