WHO WANTED THE CASE WITHDRAWN? General Sibiya Court Hearing Raises Questions Over Docket and Disputed Communications

Questions surrounding the possible withdrawal of a criminal case emerged during Tuesday’s proceedings involving General Shadrack Sibiya, as the court heard testimony about disputed communications, an affidavit and a controversial voice note.

A police witness explained that part of the investigation had involved determining whether an individual referred to as Mr M had ever indicated that the matter should be withdrawn.

The inquiry arose while the witness was examining an affidavit attributed to Mrs Dlamini and supporting material submitted by the defence.

According to the witness, Mr M confirmed that a communication attached to the defence material had been sent by him to Mrs Dlamini.

However, the witness acknowledged that Mr M had not explained why he had made the statement contained in that communication.

This left questions about its meaning and the circumstances in which it was sent.

The witness told the court that the content of the voice note remained under investigation.

The court then questioned the purpose of introducing the recording into the proceedings.

“Why are we listening to it now?” the magistrate asked, seeking clarification about the precise issue the recording was intended to address.

The exchange exposed an important distinction between verifying that a communication originated from a particular person and establishing what that communication actually meant.

A person’s confirmation that they sent a message does not necessarily establish the truth of every statement contained in it.

Similarly, a discussion about the possible withdrawal of a case does not, without further evidence, establish that a withdrawal was formally requested, authorised or carried out.

The testimony therefore raises several unresolved questions: Was the communication intended to express a wish to withdraw the matter? What was the context in which it was made? And what relevance does it have to the issues currently before the court?

The available proceedings do not establish that the criminal case was improperly withdrawn or that any individual unlawfully interfered with the docket.

Instead, they show that the circumstances surrounding the communication were being examined and that aspects of the evidence remained under investigation.

The court’s questioning demonstrates the importance of establishing the purpose and reliability of disputed material before conclusions can be drawn from it.

MDN NEWS will continue following the proceedings and reporting on further evidence placed before the court.
