The National Director of Public Prosecutions (NDPP) has instructed that fraud and corruption charges linked to the alleged irregular appointment of Brigadier Dineo Mokwele be withdrawn against Lieutenant General Dumisani Khumalo and six senior colleagues.

The accussed, Khumalo (head of Crime Intelligence), Major Generals Philani Lushaba, Nosipho Precious Madondo, Josias Lekalaka, and Zwelithini Gabela, along with Brigadiers Phindile Ncube and Dineo Mokwele faced allegations that Mokwele, a former BMW employee with a technical and engineering background, was irregularly appointed to a senior technical support role in Crime Intelligence without the required policing experience or proper processes.

According to sources, the NDPP reviewed representations submitted by the accused together with material from the Investigating Directorate Against Corruption (IDAC). The withdrawal was ordered prior to plea, citing the ongoing nature of the investigation and the lack of a complete evidentiary record. The matter cannot be reinstated without the NDPP’s explicit written consent; any future recommendation to prosecute would allow the parties an opportunity to respond.

The case, which began with arrests in mid-2025, had been postponed while the representations were considered. It has drawn scrutiny at the Madlanga Commission, where questions were raised about the strength of the original evidence, including admissions that key qualifications of Mokwele had not been properly verified before charges were authorised.
