The courtroom battle involving Vusimuzi Cat Matlala has taken a dramatic turn after a judge ordered Correctional Services and the head of CMAX prison in Pretoria to accommodate meaningful legal consultations.
Matlalaโs legal team argued that severe access limitations at CMAX were preventing proper preparation in a case involving a terabyte of digital evidence, including computer equipment and hard drives. They applied to have him brought to court for consultation purposes, citing ongoing difficulties inside the maximum security facility.
While the court declined to compel his transport, it made a powerful ruling: defence teams are entitled to proper and meaningful access to their clients. The judge directed Correctional Services and the head of CMAX to facilitate consultations in a way that allows real preparation, not token visits.
This development raises serious questions about the balance between maximum security detention and constitutional fair trial rights.
