Municipal Manager April Ntuli laid the charges following findings of widespread irregularities in the municipality’s fleet department.

According to a local report the probe revealed that millions were spent on trucks, bakkies and heavy machinery that were either never delivered or became unusable shortly after acquisition.

According to preliminary findings, officials approved invoices as proof of delivery despite vehicles never arriving.

Investigators flagged duplicate engine numbers on some assets, while others were reportedly registered under third parties instead of the municipality.

Reports suggest the municipality paid for up to 17 vehicles but received only a fraction, with at least one vehicle still unaccounted for.

Phiri’s appearance was postponed after he requested additional time to finalise his statement. The commission has now directed him to return on 20 April 2026, with instructions to submit a signed version of his statement at least five days before his next appearance.

Phiri briefly appeared before Commission Chair, Mbuyiseli Madlanga.

Evidence leader Mpilo Sikhakhane told the commission that Phiri’s draft statement remained unsigned. Phiri confirmed that he needed between two to three days to complete it, prompting the postponement.

The commission emphasised the importance of receiving a finalised statement to ensure proceedings continue without delays.

Earlier testimony from Deputy Commissioner Sean Bolhuis implicated Phiri in alleged irregular conduct. Bolhuis stated that Phiri did not have the authority to allocate security sites to private companies, including Gubis 85 Solutions.

He described the alleged actions as irregular and in violation of proper procurement processes under the Municipal Finance Management Act, adding that the municipality lost millions through unauthorised contracts.

The commission also dealt with several administrative matters, including consultations involving other witnesses such as Gareth Mnisi and his legal team. Scheduling of upcoming testimonies remains a priority, with coordination among evidence leaders to avoid clashes.

Justice Madlanga issued firm instructions regarding Phiri’s return.

“You must appear on the 20th of April 2026,” he said, stressing the importance of compliance.

Phiri acknowledged the directive without objection.

At the heart of the controversy is Raymond Singathini Chigogwana, a seasoned Zimbabwean banker and CEO of Access Finance Group. His companies allegedly facilitated the transfer of large sums of money—over R800 million—on behalf of Zimbabwean businessman Wicknell Chivayo. The funds, linked to a 2023 election printing tender awarded to South African company Ren-Form, have triggered investigations by both Zimbabwean and South African authorities into suspected money laundering.

Chigogwana’s financial operations—spanning Johannesburg and Harare—are believed to have played a role in rapidly moving the funds across multiple banks and accounts. According to the South African Financial Intelligence Centre (SAFIC), this pattern of movement fits the money-laundering model known as “layering,” which involves hiding the origin of illicit funds through complex transactions.

The Zimbabwe Anti-Corruption Commission (ZACC) confirmed its investigation, with its chairperson stating that documents were being prepared to support formal charges. Chivayo’s former business associates, Mike Chimombe and Moses Mpofu, have also been questioned.

Ren-Form received R1.2 billion from the Zimbabwean government as part of the election contract and reportedly paid R800 million to Chivayo for his role as broker. The company maintains that all dealings were above board and within legal frameworks, though it did not comment on the detailed money trail identified by SAFIC.

Investigators found that significant portions of the money were paid to Chivayo’s companies—Intratrek Holdings, Edenbreeze, and others—before being disbursed across several businesses and individuals. Some of the funds were reportedly spent on luxury items and properties in various countries, including South Africa, Zimbabwe, the U.S., and the U.A.E.

Authorities suspect that this complex network of transfers and purchases may have included payments not aligned with declared business purposes, raising red flags under anti-money laundering laws.

Financial regulators in South Africa are now examining whether Ren-Form, Chigogwana, and Chivayo’s entities were involved in violating financial compliance rules.

The SAFIC report concluded that although the transactions involved were presented as legitimate business dealings, the rapid movement and unusual nature of the activities strongly suggest possible criminal activity.

Zimbabwe had previously been grey-listed by the Financial Action Task Force (FATF) in 2019 due to deficiencies in its anti-money laundering systems and was only removed in 2022. This latest scandal risks bringing renewed scrutiny and economic consequences.

This case serves as a powerful reminder of the importance of transparency, due diligence, and accountability in public procurement—especially in electoral processes where public trust must be safeguarded.

Ameen was caught in 2017 with $544,200 and nearly R3 million in cash at Cape Town International Airport while preparing to board a flight to Dubai. He was arrested on the spot and later entered a plea agreement on charges of money laundering and breaching exchange control regulations.

In contrast, no charges were filed against President Ramaphosa following the discovery in 2020 that large sums of U.S. dollars were hidden inside furniture on his Phala Phala farm. The money, allegedly stolen during a break-in, was never officially declared or banked, and questions surrounding its origin remain unanswered.

Although several investigative bodies cleared the president of any wrongdoing, critics argue that the incident revealed clear inconsistencies in how South Africa’s justice system treats ordinary citizens compared to powerful political figures.

The African Transformation Movement (ATM) has been vocal in demanding accountability. The party’s leader, Vuyo Zungula, said the treatment of Ameen versus the handling of the Phala Phala case exposes “blatant double standards.”

According to Zungula, no one involved in the Phala Phala affair—be it the farm staff, law enforcement, or the president himself—has been held accountable, despite apparent legal violations. The party is now pursuing court action to challenge the findings that exonerated the president.

The National Prosecuting Authority (NPA) in Limpopo previously stated that no one would be prosecuted in the Phala Phala matter due to insufficient evidence for a successful case.

Zungula argued that this sets a dangerous precedent where politically connected individuals can evade justice, while ordinary citizens face full legal consequences for similar offenses.
