]]>Known as Witness E, the man told the commission that he was warned in advance about the plot to kill Magaqa. According to his testimony, the gunmen themselves informed him that they had been hired to carry out the murder, insisting the information came directly from them and was not based on rumours.
Despite receiving this warning, Witness E failed to take action. Under questioning, he could not clearly explain why no steps were taken to prevent the attack.
Witness E described himself as an experienced intelligence operative, claiming a flawless track record in infiltrating drug cartels, stock-theft syndicates and cash-in-transit gangs. He told the commission that suspects he previously identified were either imprisoned or killed.
Magaqa, who was 35 years old, was shot alongside two fellow councillors on 13 July 2017. The attack happened outside a general dealer following a council meeting in southern KwaZulu-Natal. He later died on 4 September 2017 from complications related to the shooting.
In July 2025, one of the hitmen linked to the murder was sentenced to 25 years in prison.
Commission chair Justice Mbuyiseli Madlanga pressed Witness E on the serious failure to act, questioning how such detailed intelligence could be ignored. When asked whether the gunmen had also named those who helped plan the killing, Witness E confirmed they had, claiming the alleged masterminds were his superiors.
However, he refused to reveal any names, citing safety concerns and operational limitations.
The witness ultimately agreed that the murder could have been prevented if action had been taken between the warning and the shooting.
His testimony comes amid broader scrutiny over alleged political interference in the investigation into Magaqa’s killing, an issue that continues to raise troubling questions about accountability, intelligence failures and justice.

Thokozani Nzuza from Nancefield Hostel in Johannesburg was shot and killed after the MKP had a recruitment programme in Dube Hostel on Sunday.
According to the Chairperson of the MKP in Dube Hostel Nobuhle Ndlovu blamed the Inkatha Freedom Party (IFP) for Nzuza’s death.
“We blame the IFP for Thokozani’s because they made sure that they intimidated us when we were running our recruitment programme in Dube Hostel. They are ones who came and hurled insults towards our members telling us that Dube Hostel was for the IFP only. They even told us that lives will be lost and after we were done with our programme they started shooting at us.
“Two more people were rushed into local clinics after they shot by IFP members. Unfortunately Thokozani did not make it. They followed him on foot where they shot him while he was walking back to Nancefield Hostel where he was staying,” he said.
On Monday the MKP released a statement noting the tragic incident that occurred at Dube Hostel in Soweto on the afternoon of November 23rd, 2025 during an MK Party recruitment campaign drive.
“Two members, a male and female, were shot and rushed to the hospital. The members received treatment at Bara Hospital, one was discharged at around 8pm, while the other remains in critical condition, fighting for his life at the same hospital. Tragically,the third member was shot multiple times and passed away at the scene. The shooting took place as Nzuza was returning from taking the injured to the hospital and opening a case at the Meadowlands police station,” the statement reads.
The incident is now under investigation, with both attempted murder and murder cases opened at Meadowlands police station.
“The MK Party extends its deepest condolences to the family of Nzuza and support to the families of the injured members. The Party is cooperating with authorities to ensure a thorough investigation and justice is served. As the MK Party, we unequivocally state that there will be no “no-go zones” in Gauteng, or anywhere else in the country.
“We will not yield to acts of political intolerance and intimidation. The MK Party will formally report these acts of violence and intimidation to both the South African Police Services (SAPS) and the Electoral Commission. Our country has endured a long and painful journey from the days of political violence in trains, hostels and communities; we refuse to allow a return to that era at the hands of individuals who disregard democracy. The MKP further callednon all their members and supporters to refrain from responding to this cowardly violence with retaliation against members of other political parties.
“Ours is a peaceful revolution dedicated to the complete liberation of black people, in particular. Our mission is to free even those who oppose us from mental bondage and lead society toward genuine freedom, equality and the restoration of dignity for all. Further updates will be provided as more information becomes available. The MK Party appreciates the efforts of the police and medical personnel responding to the incident,” the statement reads.
Gauteng Saps spokesperson Colonel Dimakatso Hello confirmed the incident.
” A case of attempted murder was opened on 23 November 2026 opened on for further investigation. The complainant alleges that, they were conducting a recruitment drive at Dube Hostel when they saw two people arguing. As she approached them, she heard gunshots and saw one man falling down who since been admitted in hospital with gunshot The injuries. The circumstances of the shooting is subject to police investigations and no one is arrested as yet,” she said.

Mkhwanazi recently made serious allegations against Police Minister Senzo Mchunu and deputy national police commissioner, Lieutenant General Shadrack Sibiya, accusing them of interfering with investigations and obstructing justice. The MK party views his actions as a brave stance against corruption and political manipulation.
Party spokesperson Nhlamulo Ndhlela commended Mkhwanazi’s leadership, noting his efforts to tackle political killings and high-profile murders, calling it “essential to restoring public trust in the justice system.”
In a firm statement, the MK party urged Mkhwanazi to file criminal charges against both Mchunu and Sibiya within 24 hours. They also demanded Mchunu’s immediate arrest, insisting there is clear evidence of misconduct that warrants swift legal action.
“This is not a political plea; it’s a demand for justice,” said Ndhlela, emphasizing that failure to act would further fuel suspicions of political interference and protection at the highest levels.
He called on the national police commissioner, General Fannie Masemola, to support Mkhwanazi in taking decisive action.
The controversy centers around the disbandment of the political killings task team — a unit formed in 2018 to investigate politically motivated violence in KwaZulu-Natal. Mkhwanazi claimed the unit was shut down without proper procedure, just as it was closing in on a network involving police officials, prosecutors, and even Members of Parliament. The investigation dockets were allegedly archived by Sibiya in Pretoria.
The Economic Freedom Fighters (EFF) have also thrown their support behind Mkhwanazi. The EFF criticized Mchunu’s decision to dissolve the task team and called for accountability from those in power.
As pressure mounts, questions grow about the motives behind shutting down a team that was investigating some of the country’s most sensitive political crimes. With growing public support behind Mkhwanazi, the demand for justice is becoming harder for authorities to ignore.
