A North West family has been left devastated after the man who killed their daughter — and was sentenced to life in prison — was unexpectedly released on appeal.

 

Atlholanang William Mosiane, a traffic officer, confessed to shooting his partner, 35-year-old Dimpho Motlodi, five times in front of their young son in Tlhabane in March 2021. He later handed himself over to police, pleaded guilty, and in November 2023 was given a life sentence.

 

But in May this year, just over a year into that sentence, Mosiane successfully appealed his conviction. The appeal argued that his trial was invalid because it had been held without court-appointed assessors, as required by law in certain cases.

 

The North West High Court agreed, ruling that the original court had not been properly constituted. Judges set aside both the conviction and the sentence, ordering Mosiane’s immediate release.

 

A Shocking Encounter

 

The news came as a shock to Dimpho’s parents — not through official channels, but when her father unexpectedly saw Mosiane walking in Rustenburg two months later.

 

“We knew that he got a life sentence, so we are in a state of shock,” said her mother, Winnie, 62. “For two years we went up and down in court. We don’t even know what steps to take. We are tired.”

 

Legal Loophole

 

During his trial, the magistrate had asked Mosiane’s lawyer whether assessors were necessary. The lawyer replied “not necessary,” and the matter was not pursued further. On appeal, Mosiane argued that he had not been fully informed about the legal implications of waiving assessors.

 

The high court accepted this argument, declaring the proceedings invalid.

 

For Dimpho’s family, the decision has reopened wounds they were struggling to heal. “The court’s decision has shattered us,” Winnie said.

Thembekile Letlape, widely known as “The Pastry Chef,” was brutally murdered in 2024. Her partner, Sibusiso Zitha, has now been found guilty in the Johannesburg High Court.

 

He admitted to killing Thembekile by stabbing her multiple times during an argument at their apartment in Fourways, Johannesburg. Their 10-year-old daughter witnessed the horrific incident.

 

The court has postponed the case to August 28 to allow for a pre-sentence report. The National Prosecuting Authority welcomed his guilty plea, noting that it shows he is taking responsibility for his actions. They remain confident that the court will impose a fair sentence after considering arguments from both the prosecution and defence.

A woman from Johannesburg has come forward with details surrounding the shocking death of Emmanuel Mahamba, a Zimbabwean national who was run over and killed in Sandton, reportedly by her long-term partner.

 

The brutal incident took place outside a motorbike parts store in Rivonia where the woman, identified only as Ntombi, works. The suspect, a Ugandan man and father of Ntombi’s two children, is believed to have intentionally driven over Mahamba multiple times with a Ford Ranger bakkie.

 

A video of the hit-and-run quickly circulated online, showing Ntombi screaming and attempting to stop the driver as the incident unfolded. Despite clear footage, no arrest has been made, prompting public outrage and calls for justice.

Speaking in a Facebook Live discussion with an activist and legal professional, Ntombi confirmed that she had briefly dated Mahamba in January, even though she was still living with her children’s father. She ended the relationship with Mahamba after other Ugandan men recorded them together and sent the footage to her partner, escalating tensions.

 

Ntombi said on the day of the incident, Mahamba arrived at her workplace with the same group of men. Her partner was already present when a confrontation broke out. She recalled hearing shouting, seeing Mahamba with a stone, and witnessing him break the vehicle’s windscreen. That’s when, according to her, her partner became enraged and physically attacked Mahamba before allegedly running him over.

 

The tragedy has sparked discussions in both South African and Zimbabwean communities, with many questioning why the alleged perpetrator has not yet been apprehended. Legal support has since been extended to Mahamba’s family to help with funeral arrangements and pursue justice.

 

Police confirmed that Mahamba had an argument with the shop owner and had damaged the vehicle before being fatally struck. A murder case is under investigation, but the suspect remains at large as authorities continue to follow leads.
