]]>At the Modimolle Regional Court, Imanuwela David, alongside siblings Froliana Joseph and Ndilinasho Joseph, face charges linked to an alleged break-in at the well-known Phala Phala farm, where about $580,000 in cash was reportedly stolen.
After the prosecution closed its case, the trio applied for a discharge under Section 174 of the Criminal Procedure Act, arguing that the State’s evidence was weak and largely circumstantial. Their legal team maintained that there was not enough proof to justify continuing the trial.
However, Magistrate Peter Manthata ruled against them. In his decision, he stated that the evidence presented by the State was sufficient to require all three accused to answer to the charges.
This means the case will proceed, and the accused will now have the opportunity to present their defence as the trial continues.

]]>Ndilinasho, accused 3 was not in court due to illness. Medical certificate was submitted to the court. Today we are expecting the judgement on trial within a trial. The state is ready to call three witnesses on the main trial.
The trial is scheduled to today(13), 16, 21, 23 January and 2,3, 16 February 2026 for further hearing.

The trio are facing counts of conspiracy to commit house breaking with intent to steal and theft, two counts of house breaking with intent to steal and theft, and money laundering which is applicable to accused one (Immanuwela David).

The state is ready to proceed with the trial and is intending to call 22 witnesses during the trial. The trial is scheduled to commence from 15, 17 and 30 September, then 01, 03,06 – 08 October 2025.
