										<content:encoded><![CDATA[<p>KwaZulu-Natal (KZN) Police Commissioner Lieutenant Nhlanhla Mkhwanazi has filed an urgent application in the High Court in Durban against Businessman Calvin Mojalefa Mathibeli, seeking to have statements about him declared false and defamatory.</p>

<p>According to court papers filed on 19 February 2026, Mkhwanazi is asking the court to declare social media and media statements about him false and defamatory.</p>
<p>&nbsp;</p>
<p>He wants the court to interdict Mathibeli from repeating claims that he is corrupt, criminal, captured by private interests, or involved in unlawful killings.</p>
<p>&nbsp;</p>
<p>This stems from the police raid from uis offices that took place on Friday where it was alleged that Calvin Security Personnels were held hostage by SAPS.</p>
<p>&nbsp;</p>
<p>This led to Mathibeli posting a lengthy letter detailing a 7-year battle with KZN SAPS and Mkhwanazi whom he claimed want him dead.</p>
<p>&nbsp;</p>
<p>As if that was not enough, Mathibeli made some explosive allegations accusing Mkhwanazi of being a rogue police officer who was taking protection fees from taxi owners in KZN.</p>
<p>&nbsp;</p>
<p>In his court papers, Mkhwanazi stated that he orders the removal and retraction of all such posts within 24 hours and equire public retractions on TV and radio platforms where the statements were allegedly repeated.</p>
<p>&nbsp;</p>
<p>He further said he will pursue damages in separate proceedings.</p>
<p>&nbsp;</p>
<p>The matter has been brought on an urgent basis and is set to be heard on 24 February 2026.</p>
<p>&nbsp;</p>
<p>Mkhwanazi argues that the statements harm his reputation and integrity as a senior police official.</p>
<p>&nbsp;</p>
<p>Mathibeli has been given an opportunity to oppose the application which he has already filed later on Thursday in Sandton.</p>

										<content:encoded><![CDATA[<p>A judge in Johannesburg&#8217;s South Gauteng High Court recently turned down a woman&#8217;s request for temporary financial support during her ongoing divorce. She was asking for help with child care costs, her own living expenses, and some money toward her legal bills while the divorce gets sorted out.</p>
<p>This kind of request is meant to provide quick, temporary help for spouses and kids when a marriage is ending, keeping things fair and affordable in the meantime.</p>
<p>The judge decided she hadn&#8217;t been completely open about her money situation. It turned out she had overstated how much she needed and downplayed the help her husband was already giving.</p>
<p>The couple got married in 2012 without sharing property, but with a system where they&#8217;d split any growth in assets later. They have two young kids, ages nine and four. Things fell apart, and they separated in December 2023. The kids are mostly with the mom right now, and the dad sees them regularly but not as much as he&#8217;d like.</p>
<p>The dad asked the court for more time with the kids and even shared living arrangements. They talked about adding some extra overnight visits during the hearing, but the judge didn&#8217;t change anything yet, saying there wasn&#8217;t enough info to decide.</p>
<p>Instead, the judge sent the parenting issues to a family advocate for a proper look and report. This neutral expert will help figure out what&#8217;s best for the kids. Until that&#8217;s done, the current setup stays the same.</p>
<p>The woman wanted R20,000 a month for the kids, R30,000 for herself, and R80,000 for lawyer fees. She said she quit her job at her husband&#8217;s suggestion to focus on raising the family, and he&#8217;d been the main earner.</p>
<p>But the husband showed he was already covering close to R38,000 a month for her and the kids&#8217; needs, like cash, school, medical stuff, and more. He also questioned her claims about his earnings and said she could support herself.</p>
<p>After checking everything, the judge saw that she hadn&#8217;t mentioned all the support he was providing or her own income fully.</p>
<p>The judge pointed out that these requests require total honesty and full details about finances. Hiding stuff or misleading can sink the whole claim.</p>
<p>She claimed she had no money, but didn&#8217;t share the full picture.</p>
<p>The judge also said no to the legal cost help, because she didn&#8217;t prove she really needed it, that he could afford it, or that it was essential for her case.</p>
<p>In the end, the judge made her pay his legal costs and dismissed her entire request.</p>
<p>The main divorce case is still going, and the family advocate&#8217;s report will likely shape decisions about the kids moving forward.</p>

<p>The man, whose identity is withheld to protect the child, took his case to the Western Cape High Court after the Cape Town Magistrate’s Court ruled that he was the father. Representing himself, he argued that it had not been proven “beyond reasonable doubt” that he is the child’s biological parent.</p>

<p>The case dates back to 2001, when the first paternity test indicated that he was not the father. Years later, in 2016, the child’s mother approached the maintenance court, insisting that he was indeed the biological parent. A second test was ordered in 2017, because the earlier test did not meet accreditation standards. This time, the results showed that he was the father.</p>
<p>&nbsp;</p>
<p>A new magistrate later took over the matter and inexplicably ordered a third test in 2019, which again confirmed paternity. The case was then reassigned, and yet another magistrate requested a fourth DNA test. The man objected, bringing an application to have the magistrate recused and the directive set aside. A fourth magistrate eventually ruled that another test was unnecessary and that the court would work with the evidence already on record.</p>
<p>&nbsp;</p>
<p>After hearing the case, the court ruled once more that the man was the father.</p>
<p>&nbsp;</p>
<p>Still unhappy, he turned to the High Court, arguing that the DNA results were never properly introduced into evidence and should not have carried weight unless supported by expert testimony. He also claimed that the labs that conducted the later tests were not located in the Western Cape and had compared his results to the wrong population group.</p>
<p>&nbsp;</p>
<p>He acknowledged knowing the mother years ago but denied ever being romantically involved with her. He said she used to visit his bar in 1999 but that he banned her after she stole a photo—something she later returned. He insisted he had no contact with her again until 2001, when his wife informed him that the woman was claiming he was the father of her four-month-old baby.</p>
<p>&nbsp;</p>
<p>The mother’s timeline was inconsistent in several areas, but she remained firm that she and the man were intimate in early August 2000, when the child was conceived.</p>
<p>&nbsp;</p>
<p>After reviewing the case, the High Court concluded that even if the maintenance court made errors in handling the DNA evidence, it still reached the correct conclusion. The judges noted that the second and third DNA tests showed a high probability that he was the father, and that DNA testing is a well-established scientific method with strong evidential value.</p>

<p>His appeal was dismissed.</p>

<p>The councillors maintain that their removal was procedurally flawed and politically motivated, asserting that the party failed to follow its own internal disciplinary and constitutional processes. Two Cease and Desist letters were issued to ActionSA’s leadership, cautioning the party against proceeding with replacements while the dispute remained unresolved. These letters, however, were ignored, prompting the councillors to turn to the courts for urgent intervention.</p>

<p>The eight councillors were informed at the end of September of their removal as PR Councillors for ActionSA, effectively vacating their seats in the Johannesburg Council. The councillors argue that the decision was taken without affording them a fair hearing or the opportunity to appeal, in contravention of both the party’s constitution and the principles of natural justice.</p>
<p>&nbsp;</p>
<p>Their application to the High Court seeks to suspend any attempt by ActionSA to submit replacement names to the Independent Electoral Commission (IEC) until the legality of their dismissal has been determined.</p>

<p>The urgent hearing will take place on 28 October 2025 at the High Court in Johannesburg. The councillors are represented by their legal counsel, and further public statements will be issued following the court’s decision.</p>
