Madyo is fingered to be the person who could have saved the life of Babita Deokaran who was a corruption whistle-blower.

Deokaran was assassinated in a hit-style killing outside her south Johannesburg home in August 2021 after she flagged the Tembisa Hospital corruption scandal which cost it an estimated R800 million.

In her role as Chief Director in Financial Accounting, Deokaran had been a bulwark against irregular and dubious payments.

Owing to her position, she was also in control of the evidentiary paper trail left by those who preyed on public funds.

Madyo, who was warned by Deokaran about irregular contracts at Tembisa Hospital shortly before the whistleblower’s murder, did not resign as previously claimed.

New information in the Gauteng Legislature reveals Madyo actually left the department in July 2024 through a confidential settlement while facing disciplinary charges over procurement irregularities. At the time, the department told the public she had resigned.

Madyo had also been suspended on full pay for nearly two years, reportedly earning around R3 million, before the case was quietly settled.

On Thursday Gauteng Premier Panyaza Lesufi noted the statements and allegations made by the Democratic Alliance (DA) regarding the monetary settlement reached between the GDH and Madyo.

Lesufi dismissed any insinuation that he was part of the arrangements to release the pension payout of the department’s former CFO and would like to point out that Madyo’s disciplinary hearing commenced prior to his tenure.

“The DA knows that in terms of the Public Service Act and applicable regulations, the Premier does not possess the authority to appoint or dismiss chief financial officers employed at the deputy director’s general level. Legally, that responsibility belongs exclusively to the Executive Authority overseeing the specific department that employs the individual.

“Regarding this case and in line with the legal prescripts, the Office of the Premier did not form part of the negotiations and decision-making that led to the monetary settlement. The Department of Health did engage the Office of the Premier after the agreement had been finalised, notifying the Premier of the outcome and requesting retrospective concurrence,” the statement reads.

Lesufi declined to grant this retrospective approval, citing the lack of consultation or prior involvement of his office.

“An independent legal firm has since been appointed to investigate the matter and determine whether the agreement was handled correctly and to advise on any further action required. The Premier shares the public’s concern regarding any expenditure of public funds and remains fully committed to rooting out corruption and ensuring accountability.We will not hide any form of wrongdoing, especially on matters related to the unfortunate loss of life of the late Babita Deokaran,” the statement reads.

Witness F said the direction came from Deputy Police Commissioner Shadrack Sibiya, and he shared Musa Khawula’s arrest warrant with Matlala.

According to the news reports, the Madlanga Commission heard that Cat Matlala was approached to help police locate Musa Khawula following his X post exposing Vusumuzi Matlala’s alleged criminal and gang links.

Witness F testified that a warrant of arrest was issued against Khawula under the Cybercrime Act and crimen injuria for his social media posts.

Witness F said Khawula’s post accused Matlala of fraud at Tembisa Hospital, involvement in drug operations through DJ Sumbody, and links to the killing of Babita Deorkaran.

Deorkaran was a South African whistleblower murdered for reporting corruption at the Gauteng Department of Health, where she was working as the acting chief director financial accounting officer.

Matlala was also connected to Vusi Khekhe of the Boko Haram gang, while his wife Cordelia faced legal scrutiny for travelling with police blue lights.

Vusi Matlala owns CAT VIP Protection Services.

Vusi Matlala is friends with Vusi Khekhe, and he is the co-boss of the Boko Haram gang.

Vusi Matlala stands accused of defrauding R1 million at Tembisa Hospital.

Cordelia recently had a lil run-in with the law for travelling with police blue lights on.

Matlala is connected in the killing of Babita Deorkaran.

Vusi Matlala used to operate his drug business through DJ Sumbody, who was shot in a strain of bullets in 2023.

Police enlisted Cat Matlala’s security company to help locate Khawula, as Matlala reportedly knew his weekend movements. Witness F explained that the decision came from Sibiya and was influenced by pressure from Deputy Police Minister Cassel Mathale.

He confirmed he only shared the arrest warrant with Matlala and no other details.

This suspension must not become a symbolic gesture, where officials are perpetually suspended, only to return to work later. This must be a turning point towards meaningful accountability, justice and structural reform in Gauteng’s broken health system.

ActionSA urges the Premier to institute the following:

Transparent investigation and criminal referrals

The suspension must be accompanied by a full, independent investigation into Malotana’s role in the procurement and administrative failures at the hospital. Should evidence emerge, criminal charges must follow. The public deserves to see the names, evidence, prosecutions and sentencing.

Responsibility must extend to all implicated officials

This is not just about one individual. The SIU report has implicated many service providers, hospital staff and health department officials across different levels. All those complicit – through action or omission – must face disciplinary and criminal consequences.

Interim appointment must not create further lapses

The appointment of Dr Darion Barclay as acting head, whilst welcome, must be accompanied by a mandate to immediately stabilise the department, ensure continuity of critical services and protect whistleblowers and data. ActionSA will monitor whether he is empowered rather than handcuffed.

Public release of performance agreements and lifestyle audits

Lesufi has promised that performance agreements of MECs would be published on Thursday, 16 October. That transparency must extend to departmental leadership. Lifestyle audits should be applied not only to SCM officials but all senior staff in the Health Department to help rebuild public trust.

Full restoration of Tembisa Hospital’s services

Whilst the focus is on corruption, patients are still suffering. The partially destroyed Accident and Emergency unit and other damaged sections must be fully restored, urgent maintenance must commence, and staffing gaps filled immediately.

Procurement overhaul across Gauteng Health

This suspension should kick off a wholesale review of the procurement systems that enabled the looting of R2 billion from Tembisa Hospital. Digital procurement, real-time audit controls and independent oversight must become standard. This will enable the early detection and prohibition of irregularities.

The looting of Tembisa Hospital is a symptom of a deeper rot in Gauteng Health – corruption, weak controls and impunity. The public must see more than headline gestures. They must see courts, accountability, reform and, ultimately, improved services. Otherwise, this suspension will be yet another hollow promise served to placate fed-up Gauteng residents. ActionSA will hold this administration accountable at every turn.

ActionSA remains committed to ensuring that this scandal does not fade into obscurity as another unpunished memory. • Real accountability for complicit officials. The resignation of senior managers does not constitute accountability. Officials who facilitated, condoned or ignored this corruption must face disciplinary action, criminal prosecution, civil litigation and public disclosure of their names and cases.

• Protection and justice for whistleblowers. Babita Deokaran’s murder was a direct result of the state’s failure to protect those who speak truth to power. ActionSA calls for the urgent introduction of a provincial whistleblower protection framework and full transparency on the progress of investigations into her assassination.

• Urgent restoration of Tembisa Hospital. Whilst billions were looted, patients continue to suffer in collapsing facilities. The hospital’s Accident and Emergency Unit remains gutted months after a fire, leaving communities without critical services. ActionSA demands a public timeline for infrastructure repairs, equipment replacement and the filling of critical medical vacancies.

• Structural reform of procurement systems in Gauteng Health. The SIU report reveals how weak controls allowed junior officials and external syndicates to siphon off billions. ActionSA calls for a complete overhaul of procurement protocols, including digital transparency tools, real-time auditing and independent oversight of large contracts.

This report confirms what Gauteng residents have known and suffered through for years: under ANC misrule, our healthcare system has become a feeding trough for criminal tenderpreneurs and corrupt officials, whilst patients are left to die in underfunded, dysfunctional hospitals. ActionSA will not allow the death of Babita Deokaran, or the suffering of Tembisa’s residents, to be in vain. We will continue to demand accountability, push for reforms and work to deliver a government that puts people before corruption.
