Mathibeli, who is linked to the ANC and owns Calvin and Family Security Services in Durban North, rushed to court in a last minute bid to stop SAPS from entering his company premises.

But the court was not convinced.

In a decisive ruling, the judge dismissed the application, finding that it lacked urgency and ordering Mathibeli to pay legal costs to the police.

The decision clears the way for SAPS to move forward immediately with a full firearms compliance inspection at the company under Operation Buyisa.

The operation is part of a nationwide crackdown targeting illegal firearms and non compliant security companies.

Police confirmed that the inspection will proceed as planned, backed by constitutional powers and Section 109 of the Firearms Control Act.

Operation Buyisa has become one of SAPS’s most aggressive responses to rising gun violence, with officers deployed across multiple provinces to seize illegal weapons and enforce strict compliance.

Authorities say security companies are now under intense scrutiny.

Any business found operating outside the law faces serious consequences including confiscation of firearms and potential criminal charges.

SAPS spokesperson Lieutenant Colonel Vincent Mukhathi said the operation is focused on stopping the spread of illegal firearms and tightening control over licensed weapons.

He warned that inspections will continue across the country as police intensify efforts to restore order and reduce gun related crime.

The failed court bid has now placed Mathibeli and his company firmly in the spotlight as police move in.

And as Operation Buyisa gains momentum, more security firms could soon find themselves facing similar inspections.

For SAPS, the message is clear.

No one is above the law.

The courtroom showdown is being closely watched as they has been two attempts by national SAPS to raid his offices from Fourways to Durban’s Umhlanga and his house too.

Mkhwanazi filed his urgent court papers on Friday in Durban High and the proceedings have begun.

This week, the Durban High Court sentenced the 35-year-old woman to 20 years in prison after she admitted to assaulting and murdering her daughter.

According to Natasha Ramkisson-Kara from the National Prosecuting Authority, the woman had initially handed over the child to a woman she met on social media, who offered to foster the girl. The child lived with the foster mother for three years, while her biological mother went on to marry a man from the UK.

Eventually, the woman was encouraged by her husband to bring the child back so they could live together as a family. However, shortly after the reunion, tragedy unfolded.

Ramkisson-Kara recounted heartbreaking details of the child’s final moments. On May 31, 2022, the mother returned from the clinic with her youngest child, who suffers from glaucoma. After struggling to feed both the toddler and her siblings, the mother snapped.

Fueled by frustration, she violently struck the three-year-old with a rolling pin, targeting her body and head. Later, overwhelmed by the child’s crying and a soiled diaper, she continued the assault while washing her — and then strangled her.

Though the crime could have resulted in a life sentence, the court handed down a 20-year term, acknowledging the woman’s guilty plea and other considerations.

Naicker said the outcome sends a clear message: “This sentence is precedent-setting. It serves as a warning to others who might think of harming children.”

She added that while no punishment could undo the pain inflicted, the ruling offers some comfort. “Our hearts go out to the siblings and loved ones. Justice brings a sense of peace.”
