One of South Africa’s most respected legal minds has officially taken his place on the bench of the country’s highest court.

Advocate Tembeka Ngcukaitobi SC was sworn in as an Acting Justice of South Africa’s Constitutional Court on Thursday, marking a significant moment for the judiciary as it navigates a demanding period of constitutional and legal challenges.

The ceremony saw Ngcukaitobi take the oath of office before Deputy Chief Justice Dunstan Mlambo, formally committing himself to uphold the Constitution, protect the rights enshrined within it, and administer justice without fear, favour or prejudice.

In a solemn pledge, the senior advocate affirmed his loyalty to the Republic and its constitutional values, underscoring the immense responsibility that comes with serving on the nation’s apex court.

Ngcukaitobi’s appointment follows a decision by Cyril Ramaphosa, who exercised his powers under Section 175(1) of the Constitution to appoint the renowned legal scholar as an Acting Justice. His term commenced on 1 June 2026 and will continue until 30 November 2026.

Widely regarded as one of South Africa’s leading advocates, Ngcukaitobi has built a distinguished career through his work in competition law, labour law and land law. Over the years, he has earned recognition for his sharp legal analysis and deep understanding of some of the country’s most complex constitutional questions.

His arrival at the Constitutional Court is expected to strengthen the institution during a busy judicial cycle, with the court continuing to play a pivotal role in shaping South Africa’s legal and democratic landscape.

The appointment has also drawn attention because of Ngcukaitobi’s standing within the legal profession, where he is viewed as a formidable courtroom advocate and influential legal thinker.
