The Gauteng High Court in Pretoria has ruled that late Congress of the People (COPE) leader Mosiuoa Lekota was not of sound mind and unable to manage his personal and financial affairs for several months before his death earlier this month.

The ruling followed an application brought by his wife, Cynthia Lekota, who approached the court seeking clarity on his mental capacity and the management of their joint estate.

Judge Anthony Millar found that Lekota had been mentally incapacitated from May 2025 until his death on 4 March 2026. This meant he was legally unable to oversee his financial decisions during that period.

The court further heard evidence that a romantic partner transferred substantial sums of money from his accounts while he was in a vulnerable condition.

The judgment noted that the withdrawals required explanation, particularly as some transactions were made even after legal proceedings regarding his mental capacity had begun.

The court has referred aspects of the matter to relevant professional bodies for further consideration.

Lekota, a veteran anti-apartheid activist and former defence minister, died at the age of 77.

Just days after the burial of former Congress of the People (COPE) leader Mosiuoa “Terror” Lekota, a legal battle has already emerged over the assets of the late veteran politician.

According to reports by the Mail & Guardian, Lekota’s wife, Cynthia Lekota, brought an application for curatorship to place his affairs under protective oversight.

The proceedings were then challenged by fellow COPE member Luzelle Adams, who argued that she has a direct interest in the estate. Adams claims that she shared a property with the late politician and that they have a child together.

Adams previously served as a Member of Parliament for the Congress of the People (COPE) between 2009 and 2014.

During court proceedings, it was reported that about R400,000 had been withdrawn from Lekota’s bank account, while a safe at his property was allegedly found open and empty.

The withdrawal reportedly occurred on the same day his son, Kotane Lekota, was appointed interim curator of the estate.

Kotane Lekota was appointed interim curator on 12 February 2026, authorising him to take control of his father’s property and bank accounts, manage investments, and oversee the family’s financial affairs.

Meanwhile, many of the estate’s primary assets are reportedly held in the Mosiuoa Lekota Family Trust.

The appointment followed a ruling by Judge Millar, who found that Lekota had been of unsound mind and mentally incapacitated from May 2025 until his death on 4 March 2026. Medical reports presented in court cited severe cerebrovascular disease and significant cognitive impairment.

While Cynthia Lekota remains the legally married spouse of the late politician, Luzelle Adams is asserting that her alleged personal and financial ties to Lekota — including claims that they shared a property and have a child together — give her grounds to challenge aspects of the estate proceedings in court.

The matter is expected to continue unfolding in court as the dispute over the late COPE leader’s assets intensifies.

The Congress National Committee (CNC) of the Congress of the People (COPE) concluded its two-day strategic meeting in Johannesburg on 6–7 December.

 

The party reflected on the party’s current position and reviewed progress in efforts to rebuild and reposition the organisation.

 

As the highest decision-making body between National Congresses, the CNC adopted a resolution to postpone the party’s National Elective Congress due to the state of readiness in the provinces and their constituencies.

 

COPE Acting General Secretary.Eric Mohlapamaswi, said the postponement is intended to allow additional time for adequate preparation. The Elective Congress will now be held from 25 to 26 April 2026, and all provincial congresses must be convened on or before 29 March 2026.

 

“We are determined to stabilise the party’s leadership, currently led by COPE Leader Teboho Loate, ahead of the 2026 Local Government Elections. Our objective is to rebuild and reposition COPE as an effective political alternative for all South Africans.

 

“We remain steadfast in our belief that COPE represents credible social democratic values, and together we can build prosperity for all. “It is time for citizens to join and support a party that is reliable, accountable, and led by incorruptible leadership,” he said.

 

Mohlapamaswi further said that COPE is poised to return strongly after the 2026 Local Government Elections.

 

“We will continue to be the voice of the voiceless and of South Africans at large. COPE will play a vigilant watchdog role to ensure that the current government serves the people’s interests.We are getting back on course and will bounce back. We call on communities to continue rallying behind COPE.

 

“Our public representatives will be more visible on the ground, fighting for the rights of our communities. Preparations for the next Local Government Elections have already begun. COPE has drawn lessons from past mistakes, and mitigation plans are now in place,” he said.
