]]>A dramatic legal showdown involving activist and former radio presenter Ngizwe Mchunu has taken a serious turn after the Gauteng Division of the High Court in Pretoria ordered his arrest for contempt of court.
In a ruling issued on Friday, the court found Mchunu guilty of deliberately defying previous court orders by republishing statements that had already been declared unlawful in an ongoing defamation dispute with Economic Freedom Fighters (EFF) leader Julius Malema.
The judgment, signed by Judge Labuschagne, authorises the South African Police Service (SAPS) to arrest and detain Mchunu for 10 days, placing him at immediate risk of imprisonment unless he complies with strict conditions set out by the court.
The contempt finding stems from an earlier defamation case brought by Malema against Mchunu.
At the centre of the dispute are allegations made by Mchunu claiming that Malema had received substantial sums of money from Nigerian sources and was involved in other forms of serious misconduct. Malema has consistently maintained that the claims were false and defamatory.
According to the court, Mchunu knowingly republished the allegations despite clear directives prohibiting him from doing so.
The latest ruling concludes that his conduct amounted to a direct violation of previous court orders issued on 12 May and 19 May 2026.
Although the arrest warrant has been issued, the court has provided Mchunu with a pathway to avoid detention.
The warrant will be suspended if he publishes an unconditional apology to the court on the social media platforms where he has been active during the past six months. He must also upload the apology to the court’s Caselines system and distribute it to media organisations where the disputed statements were previously repeated.
In addition, Mchunu is required to refrain from repeating the prohibited allegations for a period of six months.
Failure to comply could see the warrant executed and Mchunu taken into custody.
The ruling comes just days after Mchunu publicly apologised and retracted several allegations against Malema.
On 4 June 2026, Mchunu issued a statement withdrawing a number of claims after receiving legal advice. However, the High Court found that the apology fell short of the specific requirements laid out in its earlier orders.
As a result, the court determined that further action was necessary to enforce compliance.
Beyond the threat of imprisonment, Mchunu has also been ordered to pay the legal costs of the contempt proceedings on the punitive attorney-and-client scale.
Such cost orders are generally viewed as a strong judicial response and are intended to reflect the court’s disapproval of a party’s conduct.
The ruling now leaves Mchunu facing a pivotal choice.
He can comply with the court’s conditions, publish the required apology and avoid detention, or risk arrest and spending 10 days behind bars.
For now, the warrant remains active, and the legal pressure continues to mount as one of South Africa’s most closely watched political and legal disputes enters another dramatic chapter.
