The Maphumulo Regional Court in KwaDukuza in the north coast of KwaZulu-Natal (KZN) sentenced a 25-year-old man to life imprisonment for raping a 9-year-old girl in the Maphumulo area in 2022.

The accused and the complainant knew each other and the accused was living with the complainant’s family at the time of the offence.

KZN National Prosecuting Authority (NPA) Spokesperson Natasha Ramkisson-Kara said on the day of the incident, the complainant’s mother went into town leaving the complainant in the care of the accused and other minor children.

“The accused called the complainant into the house and instructed the other children to play outside. He then raped her and told her to bathe afterwards. When the complainant’s mother returned from town, she noticed that the complainant was behaving unusually and that her skirt was wet. Upon questioning, the complainant confided in her mother that the accused had raped her and mentioned that he had done so on a previous occasion as well. The mother confronted the accused, but he denied the allegations,” she said.

Kara said the matter was reported to the police and the complainant was taken to the Stanger Thuthuzela Care Centre (TCC) for medico-legal examination and psychosocial support. The accused was subsequently arrested.

In court, Prosecutor Bongani Sibisi led the evidence of the complainant and her mother (as the first report witness). The doctor who conducted the medical examination on the complainant also testified on behalf of the State.

“In aggravation of sentence, the State submitted a Victim Impact Statement (VIS) compiled by the complainant and facilitated by Court Preparation Officer Sfiso Nene. In her statement, the complainant said that the offence had shattered her dream of participating in the reed dance. She further mentioned that she now struggles to concentrate on her schoolwork,” she said.

Kara said in addition to the life imprisonment sentence, the accused was declared unfit to possess a firearm. She said the court ordered that his name be entered into the National Register for Sex Offenders.

“She went to her mother’s bedroom to fetch clothes and found her stepfather who pushed her onto the bed. The accused forcefully undressed the victim and raped her.
The incident occurred at the family home in Carnarvon on Tuesday, 5 August 2025, between 20:00 and 20:30, after the minor requested his cellphone SIM card from his father.

What started as a minor argument quickly escalated into a violent assault. The accused repeatedly lashed the child with a belt, inflicting serious injuries and emotional trauma.

The victim initially managed to escape; however, the accused demanded that he return. Upon reaching him, the accused threw the child to the ground, sat on top of him, and assaulted him further.

The accused punched, kicked, and choked the victim before striking him with a knee to the ribs.

The victim cried out for help, which alerted his mother, who intervened and came to his rescue.

A case of Assault with Intent to Cause Grievous Bodily Harm (GBH) was subsequently opened at the Carnarvon Police Station, which led to the arrest of the accused on 11 August 2025.

On Wednesday, 4 February 2026, the accused was sentenced to five years’ imprisonment. The court also declared him unfit to possess a firearm.

Sergeant Marlon Eksteen of the Carnarvon Family Violence, Child Protection and Sexual Offences (FCS) Unit investigated the matter and ensured a thorough investigation in pursuit of justice for the victim.

Seven learners from Milnerton High School may soon be expelled as education authorities consider disciplinary recommendations following a disturbing bullying incident that sparked national outrage and criminal charges.

The Western Cape Department of Education has confirmed that the school’s internal disciplinary process has been completed. After hearings held late last year, the school’s disciplinary committee recommended that seven learners be expelled. The final decision now rests with the Head of Department, who is reviewing the submitted findings.

The case stems from a widely shared video recorded in October, which showed a 16-year-old Grade 10 learner being violently assaulted and humiliated by fellow pupils. The footage, which circulated rapidly on social media, depicted the victim being slapped and punched during what authorities described as a severe bullying incident. Some of the accused learners are reportedly linked to the school’s rugby structures.

Eight learners were subsequently charged with assault with intent to cause grievous bodily harm and made their first court appearance in October 2025. They were released on bail and warning under strict conditions, including being barred from the school premises, avoiding contact with witnesses and complainants, and surrendering their mobile phones to investigators.

To allow the accused learners to complete their final examinations, alternative arrangements were made for them to study from home. They are expected to appear in court again on Tuesday, 20 January 2026.

The incident has reignited serious concerns about bullying, violence, and accountability in South African schools. Parents, civil society groups, and education activists have called for decisive action, warning that unchecked bullying can have long-lasting emotional and psychological effects on victims.

Advocates for the bullied learner have welcomed the disciplinary committee’s recommendation, describing it as an important step toward justice. They argue that schools must remain safe spaces for learning and growth, with zero tolerance for violence and intimidation.

While the disciplinary process is nearing its conclusion, supporters of the victim stress that the emotional trauma caused by the incident will take much longer to heal. As the legal process continues, many hope the case will serve as a strong warning and a turning point in how bullying is addressed in schools across the country.

Provincial police spokesperson Colonel Ledwaba confirmed that the victims’ guardians opened the rape cases, prompting police to launch an immediate manhunt.

The suspect was later traced and arrested at his hideout on Makopa Farm under the Thabazimbi policing area on 30 December 2025.

Police have reiterated their commitment to protecting children and urged communities to report all cases of sexual abuse involving minors.

” I want to visit her at Nkowa Nkowa. I need to talk to her, ” said Boshielo

With the high rate of abuse of alcohol in the province.

Tsakane, Gauteng – The Tsakane Regional Court has sentenced a 47-year-old man from Tsakane Extension 13 to four life terms for four counts of rape of a 13-year-old minor. The court ordered the sentences to run concurrently, with his name added to the National Register for Sexual Offenders and declared him unfit to work with children.

From December 2015 until April 2016 on four different occasions when the child would go to her elderly grandmother’s place In Tsakane Ext 13 to assist her with house chores. The family friend who is also a neighbor would call the child to his place, rape her and threaten to kill her if she told anyone the rape incidents until she fell pregnant.

In October 2016 when the 13-year-old minor had gone back to the doctor for her regular cancer treatment, the doctors discovered that she was 6months pregnant and had contracted Human Immunodeficiency Virus (HIV). When the doctor enquired about the pregnancy, the child disclosed that she was raped by the family friend. The mother of the child reported the matter to the police, and the family friend was arrested in November 2016. However, the matter was provisionally withdrawn and was placed back on the roll in 2020 when the neighbor was summoned by J175.

In court he pleaded not guilty to the charges and denied raping the child, however the regional court prosecutor Tholwana Jessica Khakhathiba adduced evidence that proved the man’s guilt. During sentencing, his legal representative the man asked the court to deviate from imposing the prescribed minimum sentence due to his ill health which has deteriorated since his incarceration., but Khakhathiba urged for life imprisonment, because the man did not show any remorse and continued to maintain his innocence even after conviction. Furthermore, the man committed gruesome offences towards a defenseless child which was already suffering from a chronic illness. Not only did the man impregnate the child he also infected her with HIV and took away her innocence.

The prosecutor also read into the record the Victim Impact Statement (VIS) facilitated by the Court Preparation Officer, Nothando Mbatha, which detailed the psychological, academic, social and physical trauma the child suffered because of the rape incidents.

The court found aggravating circumstances far outweighed mitigating factors, agreeing with the state that the accused showed no remorse for the offences. The sentence was deemed appropriate.

The National Prosecuting Authority (NPA) welcomes the sentence, hoping it deters potential offenders and demonstrates its commitment to combating gender-based violence (GBV).
