Three accused, Thepang Dithato (23), Kearabetswe Mofokeng (24), and Vuyani Nondey (28) were sentenced by the Bothaville Regional Court after they pleaded guilty to charges against them on Monday, 25 May 2026.

Lejweleputswa Police spokesperson Sergeant Palesa Thabana said that the sentencing emanates from an incident that occurred on Friday, 26 August 2025, at about 23:00.

During the incident, two males aged 26 and 32 were kidnapped in Bothaville. The court heard how the victims were severely assaulted, had their hands tied, and thrown into the Vaal River near Leeudoringstad. The two managed to swim and were able to cling to a tree until the morning. A passerby saw them and alerted the police, and both victims were rescued and were able to provide information to the police.

A case docket was registered and assigned to D/Sergeant Dannis Mokoena of the Bothaville Detective Services. Through his dedication, he pursued all information leading to the whereabouts of the accused.

Four suspects were traced and arrested on 8 September 2025.

After months of investigations by the investigating team and evidence presented before the court by the prosecution, Advocate Lebitsa of the National Prosecuting Authority (NPA), three of the suspects pleaded guilty on their respective charges, while the fourth accused denied charges against him and will proceed with the court trial.

Magistrate Mahlatsi handed down the sentencing to the three accused as follows:

  • Tshepang Dithato (23) was sentenced to twenty-one (21) years imprisonment on two counts of attempted murder and kidnapping
  • Kearabetswe Mofokeng (24) was sentenced to five (5) years imprisonment on one count of assault with intent to cause grievous bodily harm.
  • Vuyani Nondey (28) sentenced to five (5) years imprisonment on one count of assault with intent to cause grievous bodily harm.

ActionSA’s Ekurhuleni mayoral candidate Xolani Khumalo and his co-accused, Gauteng Anti-Crime Unit chairperson Duma Radebe, are returning to the Palm Ridge Magistrate’s Court facing a charge of assault with intent to cause grievous bodily harm (GBH).
Khumalo and Duma face charges of assault with intent to cause grievous bodily harm (GBH) and pointing a firearm at the Palm Ridge Magistrate’s Court.
The charges stem from a December 2025 anti-drug raid in the Mavimbela section of Katlehong. The operation was captured on camera as part of a high-profile crackdown.
A suspected drug dealer, Bongani Radebe, alleged that Khumalo and his team assaulted him and threatened him with a firearm during the raid.
Khumalo voluntarily handed himself over to the Katlehong police station on 19 January 2026 and was released on R2,000 bail.
Led by advocate Zola Majavu, the defense maintains that Khumalo was participating in a SAPS-sanctioned operation and did not enter the room where the alleged assault occurred. Both accused have pleaded not guilty.
After a delay on 23 April 2026 due to the state prosecutor being out sick, the trial was postponed to 14 May 2026.

A senior state advocate has been denied bail by the Pretoria North Magistrates Court in Gauteng following allegations of domestic violence, assault, and violation of a protection order.

Court Denies Bail

Magistrates Court Ruling

The Pretoria North Magistrates Court refused bail to Advocate Lucas Motshabi (42), a Senior State Advocate attached to the Asset Forfeiture Unit in the Kimberley office of the Director of Public Prosecutions.

The ruling underscores the National Prosecuting Authority’s (NPA) position that domestic violence offences will not be tolerated, regardless of the accused’s professional standing.

Charges Against the Accused

Multiple Serious Offences

Motshabi is facing several charges, including:

  • Contravention of a protection order
  • Malicious damage to property
  • Assault with intent to cause grievous bodily harm (GBH)

Background to the Case

Protection Order and Prior Cases

According to reports, the complainant—who is the accused’s wife—obtained a protection order against him in November 2025 at the Pretoria North Magistrates Court.

In December 2025, both parties opened criminal cases against each other. They were arrested and later released on bail.

The cases were postponed to February 2026, where both parties withdrew the charges through mediation.

Alleged Incident After Withdrawal of Charges

Violation of Bail Conditions

On 21 February 2026, just days after the withdrawal of charges, the accused allegedly went to the residence previously shared by the couple in Pretoria North—despite bail conditions prohibiting him from doing so.

Details of the Allegations

An argument reportedly broke out, during which the accused allegedly:

  • Assaulted the complainant
  • Removed children’s clothing from a wardrobe in front of a minor
  • Damaged the motor gate
  • Deflated all four tyres of the complainant’s vehicle

He then allegedly left the scene.

Arrest and Investigation

Accused Hands Himself Over

The complainant reported the incident to police. Following investigations, Motshabi handed himself over to authorities and was arrested on 03 March 2026.

State Opposes Bail

Concerns Raised in Court

During the bail hearing, prosecutor Advocate Tumelo Letaoana successfully opposed bail, citing:

  • The seriousness of the charges
  • Violation of a protection order
  • Concerns for the complainant’s safety

The State also argued that the accused posed a flight risk, alleging he had concealed his Kimberley address.

Court Decision

Bail Application Rejected

The court agreed with the State’s submissions and denied bail, emphasizing the need to protect victims and uphold the rule of law.

Conclusion

The case highlights the NPA’s firm stance on domestic violence and its commitment to ensuring accountability, regardless of the accused’s position within the justice system.
