										<content:encoded><![CDATA[<p>The case against Sekhukhune United footballer Shaune Mogaila has been postponed in the Tembisa Magistrate’s Court today, Monday to allow his legal team more time to finalise a proposed plea and sentence agreement.</p>
<p>&nbsp;</p>
<p>Mogaila faces charges of culpable homicide, reckless and negligent driving, and fleeing the scene following a October 2024 crash in Tembisa that claimed the life of nine-year-old Gomolemo Mavimbela and left her mother, Keo Mavimbela, with serious, life-changing injuries.</p>
<p>&nbsp;</p>
<p>Speaking after the brief appearance, Barry Bateman, spokesperson for AfriForum’s Private Prosecution Unit which is representing the Mavimbela family and another victim said the organisation was pleased the state had granted the defence additional time.</p>
<p>&nbsp;</p>
<p>“We’re pleased that the state has allowed the defence a little bit more time to complete their key proposal,” Bateman said. “Of course, we want it to be confident. We want them to put a full picture to the state to facilitate this process so that there can be justice for the family.”</p>
<p>&nbsp;</p>
<p>Bateman emphasised that AfriForum’s role is to ensure the victims’ families’ views are properly considered by the National Prosecuting Authority (NPA) before any plea deal is accepted.</p>
<p>&nbsp;</p>
<p>Once Mogaila’s defence submits the plea and sentence proposal, AfriForum will make formal representations to the NPA outlining the families’ position on whether the suggested sentence is just and appropriate.</p>
<p>&nbsp;</p>
<p>He added that the court must view the dashcam footage of the accident. “We’ve had other cases where an accused person has entered a plea and sentence deal and they walk away with a slap on the wrist,” Bateman said.</p>
<p>&nbsp;</p>
<p>“We believe that if a court has sight of the dashcam footage of this accident, they will have a full appreciation of the seriousness of what took place and they would then be in a better position to … impose a just and appropriate sentence on the accused.”</p>
<p>&nbsp;</p>
<p>The matter has been postponed to May for the defence to submit its proposal. The families continue to push for full accountability in the case.</p>

The National Prosecuting Authority (NPA) declined to prosecute Mbalula in 2023, a decision AfriForum has repeatedly described as “patently irrational” and possibly selective. The organisation obtained the police docket in 2024 and formally asked the NPA to reconsider prosecution last October.</p>

<p>The charges were laid after video footage showed Malema being handed a rifle before firing shots into the air in front of thousands of supporters. His former bodyguard, Adriaan Snyman, who owns a private security company, was acquitted on some charges and discharged.</p>

<p>Inside a courtroom filled with EFF supporters, Magistrate Twanet Olivier delivered the verdict, noting that while viral footage of the incident circulated widely, the court relied instead on authenticated video provided by the staging company, Gearhouse, which had filmed the rally.</p>

<p>Malema’s defense had argued the gun was a “toy” that fired blanks, but the court dismissed this claim, ruling that the firearm was real and that his actions put lives at risk. Both Malema and Snyman had pleaded not guilty from the beginning, insisting there was insufficient evidence to convict them.</p>

<p>The case, first brought forward by lobby group AfriForum, has dragged on for years. With Wednesday’s ruling, Malema’s bail was extended as the matter was postponed to January 23 for pre-sentencing proceedings.</p>

<p>This ruling confirms what the DA and the residents of Ngwathe, including the towns of Parys, Heilbron, Koppies, Vredefort, and Edenville, have long known: the municipality is completely dysfunctional and has failed in its constitutional obligations to provide even the most basic services, including access to water, sanitation, and infrastructure maintenance said Serfontein.</p>
<p>&nbsp;</p>
<p>She added they commended AfriForum and the Save Ngwathe group for taking decisive action where both local and provincial ANC governments failed to act. The judgement highlights the prolonged collapse of governance and the shocking inaction by the MEC for COGTA and the Free State Executive Council, despite clear constitutional duties to intervene.</p>
<p>&nbsp;</p>
<p>The DA now calls on Premier MaQueen Letsoha-Mathae to implement the court’s orders without delay:</p>
<p>&nbsp;</p>
<p>Dissolve the Ngwathe Municipal Council;</p>
<p>Appoint a competent administrator;</p>
<p>Approve an urgent financial recovery plan and budget to restore basic services.</p>
<p>&nbsp;</p>
<p>She concluded saying they will monitor the progress reports the Premier is ordered to submit every three months and will not hesitate to take further legal or political action if there is any attempt to delay or obstruct the implementation of the recovery measures.</p>

<p>This court victory is a major milestone in the broader fight against ANC-induced local government collapse across the country. We stand with the residents of Ngwathe, and we remain committed to restoring dignity, accountability, and quality service delivery at local government level.</p>
