<br />The CRL Section 22 Committee today officially unveiled a draft self-regulatory framework aimed at restoring integrity, accountability, and public trust within the Christian sector in South Africa.</p>
<p>Speaking during the media engagement, committee members stressed that this framework is not about state control of religion, but a church-led accountability process facilitated under the CRL Rights Commission, in line with constitutional protections for freedom of religion.</p>
<p>The committee highlighted deep concerns about exploitation, financial abuse, unsafe practices, and gender-based violence in sacred spaces. Leaders argued that while criminal law exists, victims are often left exposed for years through delayed court processes, intimidation, and spiritual manipulation.</p>
<p>The draft framework is built on three main pillars:<br />
• Strong internal governance and accountability<br />
• A clear ethical and professional code of conduct<br />
• Compliance with existing laws, including child protection and proper registration</p>
<p>A key proposal is the future creation of an independent Christian Council for Ethics and Accountability, democratically elected after a nationwide consultation process. This council would issue a seal of good standing to churches that commit to agreed standards, helping the public identify credible and accountable institutions.</p>
<p>The CRL Section 22 Committee confirmed that this document is only a draft, and now opens the door to broad national consultations with umbrella church bodies, denominational leadership, traditional leaders, survivors of abuse, youth and women’s organisations, civil society groups, and relevant government institutions.</p>
<p>A separate and protected process will also be held with survivors of abuse in sacred spaces to ensure safety, confidentiality, and dignity while informing reform proposals.</p>
<p>The committee also indicated that similar Section 22 processes are expected to follow for other faith sectors, including Muslim and African traditional religions, each with its own structured consultation path.</p>

<p style="text-align: center;">In 2018, Limpopo-based pastor Lethebo Rabalago was convicted after spraying congregants with the insecticide Doom during church services.</p>
<p style="text-align: center;">The criminal justice system responded decisively. Rabalago was found guilty of assault with intent to cause grievous bodily harm, convicted under the Agricultural Remedies Act, restrained by a High Court interdict, and sentenced to pay substantial fines with imprisonment as an alternative.</p>
<p style="text-align: center;">Crucially, the court ruled that congregants’ consent did not make the conduct lawful.</p>
<p style="text-align: center;">This case alone dismantles the claim that South Africa lacks legal tools to address abuse when it occurs in church settings.</p>

<p style="text-align: center;">Pastors and church leaders in South Africa have been arrested and prosecuted for fraud, sexual assault, child abuse, and financial crimes under existing law.</p>
<p style="text-align: center;">The CRL Rights Commission itself has referenced such cases as justification for regulatory reform. Yet in each instance, the law was already available and, in many cases, successfully applied.</p>
<p style="text-align: center;">This raises a fundamental question: if the law already works, why is the CRL proposing parallel oversight structures specifically for the Christian sector?</p>

<h3 style="text-align: center;">What the CRL Is Now Proposing</h3>
<p style="text-align: center;">The draft framework advanced by the Section 22 Ad Hoc Committee introduces councils, certification processes, compliance mechanisms, and public seals of good standing.</p>
<p style="text-align: center;">While described as voluntary, such mechanisms historically evolve into de facto regulation, particularly when linked to a Chapter 9 institution.</p>
<p style="text-align: center;">This is where constitutional concerns arise.</p>

<p style="text-align: center;">Sections 15 and 31 of the Constitution protect freedom of religion, freedom of belief, and the right of religious communities to govern themselves.</p>
<p style="text-align: center;">Criminal accountability already coexists with these freedoms.</p>
<p style="text-align: center;">The question South Africans must now ask is not whether abuse should be punished. It already is.</p>
<p style="text-align: center;">The real question is why the CRL Rights Commission is moving beyond rights protection into influencing religious governance and legitimacy.</p>
