Office of the Solicitor-General addresses miscommunications surrounding Tender RT19-2023

The Office of the Solicitor-General wishes to address recent miscommunications and false narratives
circulating regarding Tender RT19-2023, which concerns the expression of interest by private legal
practitioners to provide state legal services. We understand the importance of clarity and transparency
in such matters and aim to set the record straight.
1. Firm and Intact Closing Date:
• We would like to emphasize that the newly extended closing date of 19 January 2024
for Tender RT19-2023 remains firm and intact. There should be no doubt or confusion
regarding this deadline.
2. Regulatory Compliance:
• It is crucial to highlight that the Office of the Solicitor-General is fully committed to proceeding with the tender, as there are currently no alternative processes or systems in place to regulate the procurement of state legal services in compliance with applicable regulations.
3. Voluntary Participation:
• We want to clarify that participation in this tender is entirely voluntary for private legal
practitioners. It is not mandatory, and individuals or firms can choose whether or not to
express their interest.
4. Onboarding of New Advocates and Attorneys:
• In relation to Advocates and Attorneys who will be admitted during the period of the tender, and for the 36 months following the 19th of January 2024, the OSG and the Department of Justice and Constitutional Development are committed to addressing issues related to their onboarding. This will be done in accordance with our internal
procurement prescripts as envisaged in the PFMA to ensure a smooth and compliant transition.
5. Evaluation and Adjudication:
• Following the closing date of 19 January 2024, our office will diligently proceed with the process of evaluating and adjudicating the bids received. This process will adhere to
established procedures and regulations to ensure fairness and transparency.
We recognize the importance of dispelling any misunderstandings and false narratives surrounding this tender. The government remains resolute in its commitment to transparency and adherence to legal requirements in the procurement of state legal services.
The Office of the Solicitor-General assures all stakeholders of the unwavering integrity of the tender
process. We encourage interested and affected parties to remain informed and engaged throughout
this process.
