Frazer Solar claims the government breached a 2018 agreement to supply solar power equipment and electricity. The agreement was signed by Mr. Temeki Tsolo, then Minister in the Prime Minister’s Office.
However, Lesotho argues the contract was not legally approved, as it bypassed key requirements — including the consent of the Minister of Finance and Council of Ministers, as required by the law.
A South African tribunal ruled in Frazer’s favour in 2020, and the High Court upheld the award in 2021. Lesotho’s own High Court later found the deal illegal in 2022. The Government is now challenging South Africa’s jurisdiction and whether proper legal procedures were followed.
The appeal hearing began on Tuesday before seven judges. A ruling will be delivered at a later date.
