POTCHEFSTROOM – The Provincial Police Commissioner, Lieutenant General Sello Kwena and the Director for Public Prosecution, Dr Rachel Makhari welcome the sentences handed down by the Klerksdorp Regional Court on Wednesday, 28 August 2024, to Theko Ernest Mofololo Makaka (36) and Thuso Nhlapo (28). The convicts were further declared unfit to possess firearms in terms of section 103 of the Firearm Control Act, 2000 (Act No. 60 of 2000). Evidence led in court indicated that on Tuesday, 26 November 2022 at about 14:00, police were called to a scene at Z section near a tavern in Kanana Township where the body of Molifi Moshounyana (34) was found with multiple gunshot wounds. He was declared dead by Emergency and Medical Rescue Services (EMRS) on the scene. Through thorough investigations by the Anti-Gang Unit, the suspect was identified as Makaka. The suspect was arrested during a crime intelligence operation on Tuesday, 7 February 2023, by members of Potchefstroom K9, after following up on information about a person who was in possession of illegal firearms. The members searched a house in Z section in Kanana, where they found a plastic bag with explosives. The two suspects, who are both Lesotho citizens, were arrested. It was also established that Moshounyana was killed due to provision of food to zama-zamas underground. The accused were sentenced as follows: 1. Theko Ernest Mofololo Makaka: *Murder – Life Imprisonment *Possession of explosives -15 years’ imprisonment *Contravention of the Immigration Act – 2 years’ imprisonment 2. Thuso Nhlapo: Possession of *explosives – 15 years’ imprisonment *Contravention of the Immigration Act – 2 years’ imprisonment Meanwhile, Lieutenant General Sello Kwena and Dr Rachel Makhari applauded the Anti-Gang Unit Detective Warrant Officer Tumi Mashaba, Potchefstroom K9 members as well as Mr Cassius Mona, for their collaboration and diligence that resulted in the arrest and conviction. They further pointed out that the sentence, which was secured through collective efforts by the entities, will definitely send a clear message that those who commit crime will not be tolerated. Ends
