Former Municipal Manager sentenced for contravention of Municipal Finance Management Act
Nelson Thammy Kubheka, the former Municipal Manager of Dr JS Moroka Municipality, was sentenced by the Mpumalanga Specialised Commercial Crimes Court for violating the Municipal Finance Management Act (MFMA).
He was fined R50,000 or given a two-year prison sentence, along with an additional two years of imprisonment, wholly suspended for five years, provided he is not convicted of similar offences during that period.
Kubheka was initially charged with 36 counts, including fraud, theft, and contravention of the MFMA for improperly appointing six service providers in 2019, resulting in an overspend of R4.8 million.
The court found that proper procedures for procurement were not followed, leading to the overspend, but convicted Kubheka on just one count of MFMA contravention, related to R1.8 million of the total overspend. He was acquitted on the other charges.
