Brown Mogotsi Denied Bail Again as Court Finds No New Facts
North West businessman Brown Mogotsi has suffered another setback in his bid for freedom after his latest bail application was dismissed, with the court finding that the purported new facts placed before it were largely an attempt to remedy shortcomings in his previous applications.
Presiding Magistrate Annalise Tlhapi ruled on Tuesday that the evidence presented by Mogotsi did not justify reconsidering the court’s earlier decision to keep him behind bars.
The court was required to determine whether Mogotsi had presented genuinely new facts, whether his newly submitted residential addresses constituted new evidence and whether the interests of justice permitted his release.
In her ruling, Tlhapi said evidence relied upon in a renewed bail application must be sufficiently different from what was presented previously and should not simply amount to a “reshuffle of old evidence.”
ADDRESSES FAIL TO SWAY COURT
Central to Mogotsi’s latest application were residential addresses presented as part of his changed circumstances.
However, the magistrate found that the issue of Mogotsi’s residential address was not new and had been central to his previous bail proceedings.
The court recorded that five different addresses had been provided during the history of Mogotsi’s bail applications. According to the judgment, the first three were found to be incorrect and not to belong to him, contributing to the earlier refusal of bail.
Tlhapi ultimately rejected the argument that the latest addresses constituted new facts capable of changing the outcome.
The magistrate also found that Mogotsi had failed to establish himself as a trustworthy bail applicant capable of providing a reliable and verifiable residential address.
COURT CONSIDERS POSSIBLE ESCAPE RISK
The court also considered information concerning an alleged possible escape from custody.
While noting that the alleged escape had not materialised, Tlhapi said the court could not ignore or overlook information relating to a possible risk of escape.
According to the judgment, the information had been communicated by the institution where Mogotsi is being detained and precautionary measures had been considered in response.
The State opposed Mogotsi’s release on bail, maintaining that he remained a flight risk.
Tlhapi agreed that the latest evidence had not changed the court’s previous assessment.
“Based on the evidence and the information presented to the court, including the applicant’s new facts, it does not change my opinion that he is of a flight risk,” the magistrate said.
BAIL DENIED
In dismissing the application, Tlhapi found that there were no new facts warranting Mogotsi’s release and concluded that the businessman was attempting to address deficiencies in his previous bail applications, particularly those relating to his inconsistent addresses.
The court ruled that it was not in the interests of justice for Mogotsi to be released.
“Bail is denied,” Tlhapi concluded.
The matter has been postponed to 1 October 2026 for trial arrangements.
Mogotsi will remain in custody.
