Media Statement MPUMALANGA – Mxolise Benedict Mona (36), and his company, Black Brothers Productions (PTY) Ltd, were found guilty and sentenced by the Nelspruit Specialised Commercial Crimes Court on Tuesday, 1 October 2024, after they were arrested by the Hawks Nelspruit based Serious Commercial Crime Investigation for f raud, theft, or alternatively contravening the provisions of Section 235(1)(a) and (e) of the Tax Administration Act, Act 28 of 2011. The arrest and sentence follows the investigation carried forward by the Hawks that during January 2017, the company “Black Brothers Productions (PTY) Ltd” referred as accused no (1), was registered at Companies and Intellectual Property Commission (CIPC) and South African Revenue Services (SARS) for income tax purposes. Mxolise Benedict Mona referred as accused no.2, the sole director and sole signatory of the company, submitted fraudulent tax returns on behalf of the company, providing falsified information to the South African Revenue Service, claiming Paye As You Earn (PAYE) tax credits, with intention, misrepresenting and an attempt to prejudice the revenue service, causing a potential loss amount of R 929 256.81. The above potential loss amount was never paid out into the entity’s business bank accounts. Investigation was finalised both accused were sentenced in the Nelspruit Specialised Commercial Crime court on Tuesday, 1 October 2024 as follows: Accused no 1: sentenced to: R 30 000.00 fine, which is wholly suspended for five (5) years on condition that accused not be convicted on charges of fraud, theft or alternatively contravening Section 235 (1)(a) of the Tax Administration Act, Act 28 of 2011, committed during the period of suspension. Accused no 2: sentenced to: R 30 000.00 fine or two (2) years imprisonment plus an additional four (4) years imprisonment, which is wholly suspended for five (5) years on condition that accused not be convicted on charges of fraud, theft or alternatively contravening the provisions of Section 235 (1)(a) of the Tax Administration Act, Act 28 of 2011, committed during the period of suspension.
