Accused sentenced for contravention of the counterfeit goods Act
A foreign national, Tofika Raya Jamal (25), was sentenced by the Johannesburg Magistrate’s Court on Tuesday for contravention of Section 2(2) of the Counterfeit Goods Act 37 of 1997.
On 5 November 2025, a counterfeit operation was conducted by members of the Hawks’ Serious Organised Crime Investigation, the South African Revenue Service (SARS) Customs and Excise, and brand holders, where the above-mentioned suspect was found in possession of 1 900 counterfeit Nike-branded sneakers.
The suspect was then arrested.
According to reports on 20 August 2026, the suspect was found guilty of contravening Section 2(2), read with Sections 10, 16, 19 and 20 of the Counterfeit Goods Act 37 of 1997, read with the Trade Marks Act 194 of 1993, as well as contravening the Copyright Act 98 of 1978.
He was sentenced to three years’ direct imprisonment or a fine of R20 000, of which one year and six months of the sentence is suspended for a period of five years on condition that the accused is not convicted of the same charges.
