15-Year Sentence for Rapist Who Threatened to Break Into Woman’s Home
A 27-year-old man who forced his way into a woman’s home and raped her after threatening to break down the door has been sentenced to 15 years’ direct imprisonment.
Tshepo Kopedi was sentenced by the Vryburg Regional Court, sitting in Ganyesa in the North West, after being convicted of rape in terms of Section 3 of the Criminal Law (Sexual Offences and Related Matters) Amendment Act 32 of 2007, read with Section 51(2)(b) of the Criminal Law Amendment Act 105 of 1997.
The sentence follows an incident on 4 August 2022, when the 25-year-old complainant was alone at her home.
According to the National Prosecuting Authority (NPA), Kopedi knocked on the woman’s door and ordered her to open it. He threatened to break down the door and force his way inside if she refused.
NPA communications officer Lindiwe Mabaso said the woman, fearing for her safety, eventually opened the door.
Woman Dragged Into Corner and Raped
Once inside the residence, Kopedi allegedly dragged the woman to a corner of the house and raped her.
Mabaso said that after the attack, Kopedi ordered the woman to get dressed and accompany him.
The two later encountered the complainant’s aunt while walking.
According to the NPA, Kopedi feared that the woman would reveal what had happened and fled the scene.
He was later arrested and brought before court.
Faced with the evidence against him and unable to sustain his version of events, Kopedi eventually entered into a plea agreement with the State and was convicted.
Prosecutor Argues Against Lighter Sentence
The State was represented by prosecutor Seapei Molope, who argued in aggravation of sentence that there were no substantial and compelling circumstances that justified departing from the prescribed minimum sentence.
Molope also argued that Kopedi had failed to demonstrate genuine remorse.
She said he could have pleaded guilty at an earlier stage, potentially sparing the complainant further trauma associated with the court process.
Mabaso said Molope further emphasised the devastating impact of rape on victims, including the lasting emotional and psychological harm caused by sexual violence.
“Rape has a profound and lasting impact on victims, leaving emotional and psychological scars that can endure long after the offence,” Mabaso said.
Court Hands Down 15-Year Sentence
In considering the sentence, the court took Kopedi’s guilty plea into account.
However, the court found that a substantial period of imprisonment remained appropriate given the seriousness of the offence.
Kopedi was subsequently sentenced to 15 years’ direct imprisonment.
The sentence was welcomed by the Director of Public Prosecutions in the North West, Dr Rachel Makhari.
Makhari said the outcome demonstrated that perpetrators of gender-based violence would be held accountable for their actions.
“This sentence demonstrates that the criminal justice system remains committed to protecting women and other vulnerable members of society. Those who violate the dignity and bodily integrity of others will face serious consequences,” she said.
The case once again places the focus on the severe consequences of sexual violence and the criminal justice system’s response to perpetrators who target vulnerable victims in their own homes.
