Media Statement NORTHERN CAPE – Kimberley Commercial Crime Courts convicted and sentenced Mr Fabian Royston Tun (55) for contravention of Tax Administration Act 28 of 2011 on Thursday, 22 August 2024. The accused as a medical doctor operating as a Sole Proprietor trading’ F. R. Tun Practice’ failed to submit personal income tax returns from 2015 to 2022. During the said period, accused made taxable income and such taxable income was not declared to the Commissioner of the South African Revenue Service. SARS suffered a potential loss exceeding R4 million. On 22 August 2024, the accused was today found guilty on eight (8) counts of failure to submit personal income tax and forty two (42) counts on failure to submit value added tax returns. In relation to eight (8) counts, the accused was sentenced to two (2) years imprisonment wholly suspended for the period of five (5) years on condition that the accused will not commit same offence.
On count 9-50, the accused is sentenced to a fine of R10 000 or 4 months imprisonment of which R5 000 or 2 months imprisonment per count, which is suspended for the period of five (5)5 years on condition that he does not commit the same offence.
