Media Statement POTCHEFSTROOM – The North West Provincial Commissioner, Lieutenant General Sello Kwena and the Director for Public Prosecution, Dr Rachel Makhari, welcomed a combined 50 years’ imprisonment handed down by the Mmabatho Regional Court on Tuesday, 25 June 2024. The accused were sentenced in connection with an incident that occurred in Lomanyaneng on Saturday, 04 June 2016, where a 57-year-old Jacob Mtyotywa and his wife were attacked at Mosiane View, Lomanyaneng, close to Mahikeng. The couple heard the glass door being smashed and went to investigate, but were overpowered by two intruders. Information presented before the court indicated that the suspects assaulted the victims with bricks and stones before fleeing from the scene. The victims were assisted by a neighbour, who took the husband to hospital. Sadly, the husband passed away shortly after the incident. Police investigation into the matter, led to the arrest of Daddy Marang Mongale (18) and Kagiso Edward Diphoko (20) on Tuesday, 07 June 2016, only a few days after the incident was reported. The duo were found guilty for murder, attempted murder and robbery and sentenced on Tuesday, 25 June 2024, as follows:
Both convicts were also declared unfit to possess firearms in terms of Section 103 of the Firearms Control Act, 2000 (Act No. 60 of 2000) Lieutenant General Sello Kwena and Dr Rachel Makhari hailed the Investigating Officer, Warrant Officer Samuel Matiti and the Prosecutor, Advocate Gwai, for their collaborative efforts, which resulted in the arrest and successful prosecution of the convicts.
