Durban High Court Grants Separation of Trials in AKA and Tibz Murder Case
The Durban High Court has granted an application for the separation of trials in the high-profile murder case of rapper Kiernan “AKA” Forbes and celebrity chef Tebello “Tibz” Motsoane.
Several of the accused applied to have their trial separated from the additional, unrelated charges facing accused number three, Siyanda Eddie Myeza.
Following the court’s ruling, the legal proceedings regarding Myeza’s separate charges will move forward independently, while the core trial concerning the conspiracy and murders of Forbes and Motsoane continues.
The suspects collectively face a stringent sheet of charges.
Despite the restructuring of the trial proceedings, the state’s focus remains on the primary counts of premeditated violence which are conspiracy to commit murder, murder, attempted murder, and unlawful possession of firearms and ammunition.
Legal separation isolates specific additional charges linked strictly to Myeza, ensuring they do not complicate or prejudice the main trial.
All accused individuals retain the presumption of innocence until, and unless, proven guilty beyond a reasonable doubt in a court of law.
Legal experts note that a separation of trials is often utilized to prevent delays and ensure a fair trial for all co-accused.
By decoupling Myeza’s individual charges from the collective indictment, the court aims to streamline the presentation of evidence specifically tied to the tragic events outside the Wish restaurant on Florida Road.
