MEYIWA TRIAL State’s Bid to Use Photographs Sparks Courtroom Battle

A dispute over photographs has become a flashpoint in the Senzo Meyiwa murder trial, as prosecutors seek to use the images to question accused number three, Mthobisi Mncube.

The case returned to the Pretoria High Court on Monday, 5 October, following a postponement that gave the judge and legal teams time to examine the material. The prosecution and defence have clashed over the photographs’ admissibility and how they may be used during cross-examination.

The State wants to test Mncube’s account using photographs and details associated with them. The defence has challenged the introduction of material during this stage of proceedings, raising concerns about evidence being brought forward after the prosecution closed its case.

The dispute puts a crucial question before the court: what material may prosecutors use to challenge an accused person’s version?

Five men face trial over the killing of the former Bafana Bafana captain in October 2014. All have pleaded not guilty. The photographs remain contested evidence, and their use does not itself establish anyone’s guilt.
