ConCourt sets 5 October hearing in ANC fight over 181 candidates
The Constitutional Court will hear the ANC’s urgent appeal on Monday, 5 October at 10:00, as the party seeks to have 181 excluded councillor candidates reinstated on the ballot for the 4 November local government elections.
The case follows the Electoral Court’s dismissal of the ANC’s appeal on 16 September. The court found that candidates whose information was uploaded to the IEC’s Online Candidate Nomination System but not marked “submit as final” had not been validly nominated.
The dispute affects 130 proportional-representation and 51 ward candidates across six municipalities: Port St Johns, Ngquza Hill, Walter Sisulu, Sundays River Valley, uMshwathi and Mangaung.
The ANC argues that the required information and documents were captured before the 28 August, 17:00 deadline, while the IEC maintains that final submission was a required step in the nomination process.
The Constitutional Court has set a compressed timetable ahead of the hearing, which comes just 30 days before election day.
